Dogs andhorses are well used to each other’scompany and for the most part they leada very peaceful co-existence.Sometimes this isn’t the case, however,as equine specialist Brenda Gilligan,Senior Solicitor of Wilkin Chapman,points out. Brenda says, “A worryingincrease in the number of dog attacksinvolving horses and riders has beenreported in recent months. A record 39incidents were reported in March to theBritish Horse Society, who runwww.horseaccidents.org.uk, a dedicatedsite for equine accidents to be reported,so that they can monitor the situation.The previous high was 29 in May 2014.“The incidents cover horses and riderswhether being ridden or just grazing, inyards or fields, private land or publicaccess tracks. The type of dog does notseem the issue, but all were out ofcontrol at the time of the attacks. So whyis this happening and what can bedone?”Brenda says, “What can start asapparently harmless ‘play’ betweenhorses and dogs can quickly trigger thedog’s prey instinct and the horse’s flightinstinct when threatened. It thenbecomes deadly serious as the dog seesthe horse as prey, so never let dogs ‘play’with horses. “You should de-sensitise your horses todogs and vice versa by exposing them toeach other in controlled situations. Thismay prevent horses taking off in panic inan attack situation, leaving the rider incontrol.”It’s certainly likely that horses and dogswill end up meeting each other, nomatter how hard you try and keep themapart. As Brenda says, “Riders often havefew areas in which to ride other thanbridleways and while these are open todog walkers as well, the two should showcourtesy to each other. Train dogs inrecall and hold them as riders pass. Dogsshould be under close control whetheron or off a lead. Riders should slow downif they see a loose dog or a dog on a leadand give a wide berth. “Don’t let your dog out loose alone – itis dangerous for the dog as well. It now covers attacks by out of controldogs in public or private places, including houses and gardens.The breed is immaterial. It’s enough that someone is put in fearof injury and they don’t have to be actually injured for an offenceto occur. The drawback is that it only covers humans, notanimals, except assistance dogs.“For injuries to animals, we look to the Animal Welfare Act2006. This tells us that it is an offence for someone responsible foran animal to cause unnecessary suffering to another animal dueto failing to act to prevent the suffering.
