Atfirst glance, this case seemed to sound warningbells for owners who allow others to ride theirhorses, or sellers allowing potential buyers to trythem, in that they could be liable for injurysuffered if the horse misbehaved. Closerexamination suggests this may be too harsh ananalysis.The case concerned Ashleigh Harris, who was14 in 2012 when her accident occurred. She wasrendered paraplegic. It is not clear yet howmuch compensation she will be awarded, as thistrial was to establish whether Mrs Miller, theowner of the horse, was responsible for her falland injuries or whether it was a pure accident.After 5 days in court, the judge decided MrsMiller was liable to Ashleigh for compensationdue to her negligence. Mrs Miller apparentlydoes not have sufficient insurance to cover thelikely multi million pound sum that Ashleigh willbe awarded and therefore will be personallyliable to meet the award. She could lose herhouse by having to sell it to pay compensation.One thing the case does tell use is to make sureyou have proper insurance cover against claims.One of the major problems with this case wasthe lack of consistent evidence as to how theaccident actually happened. Ashleigh claimedthe horse, Polly, who she said was an excitableex-racehorse which Mrs Miller had recentlybought, “made as if to canter and gallop as ifgoing mental”, bucked and she fell off. It cannot have been easy,but he eventually concluded thatnegligence by Mrs Miller had beenestablished, that she had “made a seriouserror of judgment in acquiring anunsuitable horse” and that she was “inbreach of the duty of care owed to theClaimant as a young person for whomshe was responsible”.This is possibly the key to the verdict.Mrs Miller was an adult; Ashleigh wasthen a child in her care, despite hermother giving permission. In cases ofsharers and loaners, the parties are usuallyadults who know the horse equally welland are responsible for themselves.Similarly, in selling a horse, it is necessaryto get on at some point to assess thehorse’s suitability. But one would notexpect a child to make this decisionalone.
