Often those who are engaged towork with horses are contracted on a fairly casual basis,so it’s hard to decide whether someone working in ayard or stables is technically employed by the owner, orself-employed and being contracted to offer their ownservices.Yet as equine specialist Brenda Gilligan, SeniorSolicitor at Wilkin Chapman, points out, it’s vitallyimportant to ascertain the employment status of thoseworking to avoid potential confusion in case the worsthappens.As Brenda says, “The distinction is important for anumber of reasons, but one of them is that anemployee will generally have more rights in theworkplace if something goes wrong or they are injured. Lawyersfrequently see incidences of an employer maintaining that theirstaff are all self-employed or freelance, thus trying to avoid anyresponsibility for them, while at the same time regulating theirrole, working hours, place of work, wages and everything else youwould expect to be in the control of an employer in the strictsense of the word. “A recent case, Kate Smith vs Allan Harding, heard in 2013,illustrates the importance of being clear as to status when an injuryoccurs. Kate Smith tried to make a claim against a Mrs Lofthousewhen she was injured by a horse kept at Mrs Lofthouse’s stables asa livery. The horse was owned by Mr Allan Harding and sheclaimed against him as well. Miss Smith maintained she wasemployed by Mrs Lofthouse and as her employee, Mrs Lofthousehad a duty to her to ensure she worked in a safe environment.“Where there is a dispute over whether someone is employed ornot, there is these days no one test that will resolve the issue. In a2012 case, the Court gave helpful guidance in that it said,generally speaking, an employee works under the supervision anddirection of his employer, while an independent contractor is hisown master bound by his contract, but not his employer’s orders.An employee works for his employer, while an independentcontractor is in business on his own account.“The Court found Miss Smith was not employed.
