As FayeBentley of Diane Genders Solicitors of Lincoln points out, “Dothings wrongly and you could end up with years of unhappiness, not to mention the possibility of lengthy and expensive courtproceedings.” We asked Faye to explain the best course ofaction...The best way to keep it amicable is to talk to your spousebefore taking action. Imagine how it would feel if you receiveddivorce papers without being told your marriage was over! Talk things through with your spouse about how you arefeeling. You could try counselling if you are unsure whether ornot your marriage is at an end but if you have reached theconclusion that you can no longer continue with your marriage, act on it. The sooner you start, the sooner it will end. If you canagree who should issue proceedings it’s a great start. If you have children you should both talk to the childrentogether. When parents split up children often feel to blame andthink that you do not love them anymore. Reassure them thatthis is not the case.If the worst happens...If the worst happens...080-081:Layout 1 6/12/13 13:08 Page 1Once you’ve decided to get a divorce, youthen need to think about how the children canspend their time with mum and dad. Think aboutwhat the children are used to. Try to keep thesearrangements as much as you can to ensure thatthe children are affected as little as possible. It’shelpful to have a set routine so both parents andchildren know where they will be and when. A calendar on thefridge works wonders. If you can’t agree on arrangements between yourselves, tryspeaking to a specialist solicitor who will advise you whether yourproposals are reasonable, and will advise you on your options. Youdo not always need to go to court. The other issue is money. This can be a complex area of law andwhile it is good to try to agree what is fair with your ex, you mustthen talk to a specialist solicitor who knows what you are entitledto. Remember everyone’s case is different, so just because onefamily you know split money in one way does not mean that thisis what should happen to you and your family. To work out what’s fair you will need to know about yourfinancial situation. You need to know about your own financesand your ex-partner’s as well. What are you assets? What are yourdebts and liabilities? How much do you both earn? Do you haveany pensions or policies which may also have a value. If you wantto know more about what you could be entitled to, why notspeak to a specialist solicitor. Many solicitors, such as here atDiane Genders, offer a free initial appointment to give generalinformation in relation your separation. Many people don’t realise that even if you divorce, you can stillhave a claim against your former spouse – unless there has beenan order which stops you both making any further claims againstthe other or you have remarried. Don’t ignore financialarrangements and make sure you’re fully aware of what happensnext.LINCOLNSHIRETODAY81FAMILY MATTERSWHEN THE STORM CLOUDS GATHER YOU WILL NEED A SAFE HAVENDiane Genders Specialist Family SolicitorsWe specialise in all aspects of FamilyLaw from Children's issues, Financial issues, Divorce, Separation, Pre-nuptial Agreements to Wills and Probate and a whole range ofspecialist services for the elderly. At Diane Genders Solicitors we talkstraight, get straight to the heart ofany issue and ALWAYS have your bestinterests at the centre of our thinking. For more information contact us today on 01522 516500enquiries@dianegenders.co.ukwww.dianegenders.co.ukResolution House, Crusader Road, Lincoln, LN6 7ASDGDiane GendersSpecialist SolicitorsPHOTO: SHUTTERSTOCK.COM/CHAMELEONSEYERemembereveryone’s case isdifferent, so just becauseone family you know splitmoney in one way does notmean that this is whatshould happen to you andyour family080-081:Layout 1 6/12/13 13:08 Page 2A recent Ball at the Bentley Hotel in Lincoln raised welcome funds inthe continued fight against breast cancer. The event was organised by Melanie Pickering and Kaye Robinsonwho wanted to organise a charity ball for Breast Cancer Care as in thelast year they have had friends who have suffered with breast cancer.Happily, they are now in remission. Thesymptoms of dementia can vary from person to person, but maywell include small signs at first that could take several forms.Forgetting small things like people’s names or of something assimple as an everyday household item can be usual for olderpeople but if it happens on a regular basis it might be a causefor concern. Similarly, forgetting something you were told a fewmoments before or not knowing if you have just read somethingcan also be a sign. If you also experience extreme changes in mood ortemperament at short notice or seem to have taken on differentpersonality traits this can often be a concern too. Depressionand anxiety can often be factors, as well as more obviouspointers like being reminded of things often or perhaps gettingan unusual amount of comments regularly on yourforgetfulness. One thing which might be happening is twoconditions, vascular dementia and Alzheimer’s, developing atthe same time. The best way to deal with these concerns, especially if youhave noticed them yourself, is to go and see your GP to discusswhat you can do. It may well just be another underlying healthcondition that is causing some symptoms so it’s better to beabsolutely sure. Similarly, if you do notice someone who appearsto be struggling, then encourage them to see a GP. It mightstop them from hurting themselves or getting into dangerousDementia is something that affects a lot morepeople than you’d think. Factors as simple as eating a well-balanced and nutritious diet, combined with plenty of exercise, can do wonders for yourcardiovascular health. The old adages of drinking in moderation, increasing activity rather than being sedentary and even stoppingsmoking can all lower your risk. It is recommended that if youhave a history of dementia or mental illness within your family, easing back on vices and living more healthily will combat therisk element of developing symptoms either too early in life or ata rate that is distressing and frightening. Getting regular bloodpressure and cholesterol tests can also be a good habit to getinto.Overall, it is vitally important to stay calm. There is a lot of helpout there for those embarking on the start of this frightening anddangerous journey and the best thing to have comfort in is thatyou are far from alone.
